The question of 3 talaq in Islam (teen talaq, or triple talaq) is one of the most searched family issues in Pakistan and India. People want to know what the Quran says, what the hadith say, and why scholars give different answers. What the Quran Says About Talaq

Any discussion of 3 talaq in Islam has to start with the Quran. The Quran sets a clear limit and a process. Divorce is not meant to be one sudden word in anger. It is spread over time so that the couple can reconcile.

Surah Al-Baqarah 2:229 – Talaq is twice

طلاق دو مرتبہ ہے، پھر یا تو اچھے طریقے سے روک لینا ہے یا بھلائی کے ساتھ رخصت کر دینا ہے۔

English: “Divorce is twice. Then either keep her in an acceptable manner or release her with good treatment.” (Quran 2:229)

Surah Al-Baqarah 2:230 – After the third talaq

پھر اگر وہ اسے (تیسری) طلاق دے دے تو اس کے بعد وہ اس کے لیے حلال نہیں جب تک کہ وہ کسی دوسرے شوہر سے نکاح نہ کر لے۔

English: “And if he divorces her (a third time), then she is not lawful to him afterwards until she marries a husband other than him.” (Quran 2:230)

Surah At-Talaq 65:1–2 – Timing, iddah and witnesses

اے نبی! جب تم عورتوں کو طلاق دو تو انہیں ان کی عدت کے وقت پر طلاق دو اور عدت کا شمار رکھو۔

اور اپنے میں سے دو معتبر (عادل) آدمیوں کو گواہ بنا لو۔

English: “O Prophet, when you divorce women, divorce them for their waiting period and keep count of the waiting period” and “take as witnesses two just men from among you.” (Quran 65:1–2)

The Sunnah Way of Giving Talaq

All schools agree that the best (ahsan) way is one talaq, given when the wife is in a state of purity (tuhr) in which the couple have not been intimate, and then letting the iddah pass. During the iddah the husband can take her back. After it, they can remarry with a new nikah if both agree.

In Sahih Bukhari 5251, Abdullah ibn Umar divorced his wife while she was menstruating. The Prophet ﷺ told him to take her back, wait until she became pure, then had her period again and became pure again, and only then decide. This shows that the timing of talaq matters in the Sunnah, a point that comes up again in every discussion of 3 talaq in Islam.

• Talaq ahsan: one talaq in tuhr, then the iddah passes.
• Talaq hasan: one talaq in each of three separate periods of purity.
• Talaq bid’ah (talaq-e-biddat): three talaq in one sitting or one sentence, or talaq during menses. Scholars agree this way is against the Sunnah.

Hadith on 3 Talaq in Islam Given at Once

Two well-known authentic reports are at the centre of the discussion on 3 talaq in Islam:

• The Prophet ﷺ was angry: Mahmud bin Labid reported that a man gave three divorces together. The Prophet ﷺ stood up in anger and asked whether the Book of Allah was being played with while he was still among them. (Sunan an-Nasa’i 3401)
• Counted as one in the early period: Ibn Abbas reported that in the time of the Prophet ﷺ, of Abu Bakr, and for the first two years of Umar’s caliphate, three divorces (at once) were counted as one. Then Umar said that people had become hasty in a matter where they had been given time, so he made them take effect as three. (Sahih Muslim 1472)

Every school accepts these reports as authentic. They differ on how to understand them, which is why the ruling on 3 talaq in Islam differs between schools.

3 Talaq in Islam: Views of the Major Schools

Below is a neutral summary of each school’s well-known position. Follow the scholars of your own school, and ask them about your exact case, because the answer on 3 talaq in Islam depends on the school you follow.

• Hanafi (Imam Abu Hanifa): three talaq given together all take effect, and the marriage ends with talaq-e-mughallazah. Giving them together is sinful (bid’ah), but it still counts as three. This is the view followed by most Deobandi and Barelvi scholars in Pakistan and India.
• Maliki (Imam Malik): three at once take effect as three. Doing so is disliked and against the Sunnah.
• Shafi’i (Imam Shafi’i): three at once take effect as three. Many Shafi’i scholars do not call it sinful, but they agree it is better to give one.
• Hanbali (Imam Ahmad): the well-known Hanbali view is also that they take effect as three. Ibn Taymiyyah and Ibn al-Qayyim, both from the Hanbali tradition, held that three in one sitting count as one, based on Sahih Muslim 1472.
• Ahl-e-Hadith (Salafi) scholars: follow the view of Ibn Taymiyyah: three in one sitting count as one revocable talaq.
• Ja’fari (Imam Ja’far as-Sadiq): three talaq in one sitting count, at most, as one talaq. Ja’fari fiqh also requires two just male witnesses to be present at the time of talaq, based on Quran 65:2, and without them the talaq is not valid.

Halala: What Quran 2:230 Means

Halala is often raised alongside 3 talaq in Islam. Quran 2:230 says that after the third talaq the woman may only return to her first husband if she marries another man. Scholars of all schools explain that this refers to a genuine marriage. A pre-planned “halala” marriage arranged only to make her lawful again is strongly disapproved of by scholars across the schools, and many consider it invalid.

Teen Talaq and the Law in Pakistan and India

Alongside the religious ruling on 3 talaq in Islam, the law of your country also applies:

• Pakistan: under Section 7 of the Muslim Family Laws Ordinance 1961, a husband must give written notice of talaq to the Chairman of the Union Council and a copy to the wife. The talaq takes effect only after 90 days, and the Union Council sets up an arbitration council to try to reconcile the couple.
• India: in Shayara Bano v. Union of India (2017), the Supreme Court set aside instant triple talaq (talaq-e-biddat). The Muslim Women (Protection of Rights on Marriage) Act 2019 makes it void and a punishable offence, with up to three years in prison.

• Note whether the wife was in her menses and whether any witnesses were present.

• In Pakistan, make sure the Union Council procedure is followed. In India, seek legal advice.
• Make istighfar and avoid hasty words in future. The Quran’s two-stage process exists so that anger does not destroy a family.
